1. Agreement to terms
By accessing or using Ondara (the "Platform"), you agree to be bound by these Terms of service and all applicable laws and regulations.
Ondara is operated by Ondara OÜ, a company registered in Estonia.
2. Use of the Platform
Eligibility
You must be at least 18 years old to use Ondara. By using the Platform, you represent and warrant that you meet this age requirement and have full legal capacity to enter into binding agreements.
Account registration
To access certain features, you must register for an account. You agree to:
- Provide accurate and complete information
- Maintain the security of your account credentials
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorised access
User conduct
You agree not to:
- Use the Platform for any illegal purpose
- Violate any applicable laws or regulations
- Infringe on the rights of others
- Transmit harmful, fraudulent, or malicious content
- Attempt to gain unauthorised access to the Platform
- Interfere with or disrupt the Platform's operation
- Impersonate any person or entity
- Collect or harvest information about other users without consent
3. Role of Ondara
Ondara operates as an online marketplace connecting participants with independent facilitators.
When you book an offering through Ondara, you enter into a direct agreement with the facilitator, not with Ondara.
Ondara acts as a limited commercial agent of the facilitator solely for the purpose of collecting payments on the facilitator's behalf. Ondara is not the provider, organiser, or supervisor of the offerings listed on the Platform.
Facilitators are independent service providers and are not employees, partners, or agents of Ondara beyond payment collection authorisation.
4. Facilitator terms
If you are a facilitator publishing offerings through Ondara:
- You are solely responsible for the accuracy of your offering listings
- You must possess all required licences, permits, qualifications, and insurance necessary to conduct your offerings
- You are solely responsible for delivering the services as described
- You must comply with all applicable local, national, and international laws and regulations
- You agree to Ondara's fee structure and payment terms
- You grant Ondara the right to promote your offerings
Facilitator responsibility and indemnification
Facilitators are solely responsible for the organisation, safety, and lawful delivery of their offerings.
Facilitators agree to indemnify and hold harmless Ondara OÜ from claims, losses, liabilities, or expenses arising from:
- The delivery of their offerings
- Failure to comply with applicable laws
- Personal injury or property damage occurring in connection with their offerings
- Breach of these Terms
Nothing in this clause limits participant rights under applicable consumer protection laws.
5. Bookings and payments
Booking process
When a participant books an offering through Ondara and facilitators accepts the booking, a binding agreement is formed directly between the participant and the facilitator.
Ondara's role is limited to providing the Platform and facilitating payment collection as commercial agent.
Payment processing
All payments are processed securely through third-party payment providers.
Ondara collects payments on behalf of facilitators and deducts its service fee before transferring the remaining amount to the facilitator.
Ondara is not responsible for chargebacks, disputes, or refund obligations arising from the facilitator's services. Facilitators remain financially responsible for refunds unless otherwise required by applicable consumer protection laws.
Cancellations and refunds
Cancellation and refund policies are determined by individual facilitators and displayed on the relevant offering page. Participants are responsible for reviewing these policies before booking.
6. Assumption of risk
Participation in offerings listed on Ondara may involve physical, emotional, or psychological activities, including but not limited to yoga, breathwork, meditation, movement practices, or other wellness-related activities.
By booking or attending an offering, participants acknowledge and agree that:
- Participation is voluntary
- They are responsible for assessing their own physical and mental fitness
- They assume all risks associated with participation
- Ondara does not supervise, control, or guarantee the safety of any offering
To the fullest extent permitted by law, Ondara shall not be liable for injuries, losses, or damages arising from participation in offerings.
7. Intellectual property
The Platform and its content, features, and functionality are owned by Ondara OÜ and are protected by applicable intellectual property laws.
Users retain ownership of content submitted to the Platform but grant Ondara a worldwide, non-exclusive, royalty-free licence to use, reproduce, and display such content in connection with operating and promoting the Platform.
8. Disclaimers
The Platform is provided on an "as is" and "as available" basis without warranties of any kind. Ondara does not:
- Guarantee the accuracy of listings
- Endorse any facilitator or offering
- Guarantee the quality, legality, or safety of offerings
- Warrant that the Platform will be error-free or uninterrupted
9. Limitation of liability
To the fullest extent permitted by law, Ondara OÜ shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from:
- Use of the Platform
- Participation in offerings
- Actions or omissions of facilitators
- Inability to access the Platform
Nothing in these Terms excludes liability where exclusion is prohibited by applicable law.
10. Indemnification
Users agree to indemnify and hold harmless Ondara OÜ and its affiliates from any claims, damages, losses, liabilities, and expenses arising from:
- Their use of the Platform
- Violation of these Terms
- Participation in offerings
- Violation of applicable laws
11. Changes to terms
We reserve the right to modify these terms at any time. We will notify users of material changes where required. Continued use of the Platform after changes constitutes acceptance of the updated terms.
12. Governing law and jurisdiction
These terms shall be governed by and construed in accordance with the laws of Estonia, without regard to its conflict of law provisions.
Any disputes arising out of or relating to these terms or use of the Platform shall be subject to the exclusive jurisdiction of the courts of Estonia.
